2016 Legislative Summary

The purpose of ANA\C’s public policy agenda is to advance the profession of nursing and assure that all Californians have access to safe, timely, appropriate and high quality health care, including access to professional nursing care. ANA\C works to achieve these goals through health policy strategies developed by our Board of Directors with input from our membership.

ANA\C is actively involved in California’s Legislative process. The ANA\C legislative team regularly reviews bills, monitors legislation and regulations, establishes legislative positions and communicates with legislators, Capitol staff, coalition partners and other appropriate regulatory agencies and key stakeholders. When assessing legislation and its impact on nursing, health care and our patients and communities, ANA\C will adopt a position regarding specific bills: Support, Oppose or Watch. As these bills move through the process, that position may change. Once, important legislation is identified, ANA\C regularly tracks these bills and provides updates to our members.

This webpage describes legislation important to RNs in California. Information about these bills and others that are introduced during this legislative session will be frequently updated as ANA\C continues to represent the voice of nursing in California’s public policy arena. CALIFORNIA ASSEMBLY

AB 840 - Ridley-Thomas S (D)

Status: Vetoed by Governor

Nurses and Certified Nurse Assistants: Overtime

Prohibits a nurse or Certified Nursing Assistant (CNA) employed by the State of California in a specified type of facility from being compelled to work in excess of the regularly scheduled workweek or work shift, except under certain circumstances. Authorizes a nurse or CNA to volunteer or agree to work hours in addition to his or her regularly scheduled workweek or work shift.

Certified Nurse-Midwives: Scope of Practice

Requires an applicant for a certification to practice nurse-midwifery to provide evidence of national certification. Requires the creation of a Board of Nursing advisory council. Authorizes a certified nurse-midwife to manage a full range of gynecological and obstetric services for women. Relates to the furnishing of drugs or devices in connection with care. Authorizes specified procedures. Relates to liability for midwife acts or omissions. Authorizes nurse-midwife to provide emergency care.

AB 1386 - Low (D)

Emergency Medical Care: Epinephrine Auto-Injectors

Permits a defined authorized entity to use an epinephrine auto-injector to render emergency care to another person in accordance with these provisions. Authorizes a pharmacy to furnish such auto-injectors to an authorized entity. Requires a plan. Requires specified reporting on incidents related to the administration of such auto-injectors. Provides that the entity is not liable for civil damages resulting from any act or omission in connection with the administration of the epinephrine auto-injector.

Confidential Communications: Disclosure

Makes it a crime for a person who unlawfully eavesdrops upon or records a confidential communication to intentionally disclose, or attempt to disclose, or to intentionally distribute, or attempt to distribute, the contents of a confidential communication without the consent of all parties to the communication unless specified conditions are met. Makes it a crime for any person to employ or direct any person to commit those crimes. Provides for related penalties. Makes technical, nonsubstantive changes.

AB 1719 - Rodriguez (D)

Pupil Instruction: Cardiopulmonary Resuscitation

Requires the governing board of a school district, and the governing body of a charter school, offering instruction to pupils in grades 9 to 12, inclusive, to provide instruction in performing compression-only cardiopulmonary resuscitation as part of a required course. Encourages entities to provide to pupils general information on the use and importance of an automated external defibrillator. Provides that specified entities responsible for such course shall not be liable for such instruction.

Pupil Health: Opioid Antagonist

Authorizes the furnishing of naloxone hydrochloride or another opioid antagonist to a school district, county office of education, or charter school if certain conditions are met. Requires such entities to maintain related records. Authorizes such entities to provide the medications to specified school personnel and authorizes such personnel to use the medication in providing emergency medical aid for possible opioid overdose. Provides requirements for the State Department of Education regarding training.

Health Care Coverage: Reproductive Health Care Services

Prohibits every health care service plan contract or health insurance policy from requiring an enrollee or insured to receive a referral in order to receive reproductive or sexual health care services. Provides exceptions.

Healing Arts and Referrals

Amends an existing law providing that it is unlawful for licensed healing arts practitioners to offer, deliver, receive, or accept any rebate, refund, commission, preference, patronage dividend, discount, or other consideration as compensation or inducement for referring patients, clients, or customers to any person. Provides that the payment or receipt of consideration for advertising does not constitute a referral of services.

Professions and Vocations; Retired Category; Licenses

Authorizes any of the boards, bureaus, commissions, or programs to establish by regulation a system for a retired category of license for persons who are not actively engaged in the practice of their profession or vocation.

CALIFORNIA SENATE

SB 586 - Hernandez (D)

Children's Services

Relates to the Children's Services program, which provides medically necessary services required by physically handicapped children whose parents are unable to pay for those services. Exempts contracts entered into under the Whole Child Model program from a prohibition on services being incorporated into a Medi-Cal managed care contract under the California Service program. Extends, until an evaluation required under the Whole Child program has been completed, the termination of such prohibition.

SB 819 - Huff (R)

Powdered Alcohol

Prohibits the Department of Alcoholic Beverage Control from issuing a license to manufacture, distribute, or sell powdered alcohol, and requires the department to revoke the license of any licensee who manufactures, distributes, or sells powdered alcohol. Prohibits the possession, purchase, sale, offer for sale, distribution, or use of powdered alcohol and makes the violation of these provisions punishable as an infraction.

SB 999 - Pavley (D)

Health Insurance: Contraceptives: Annual Supply

Requires a health care service plan or health insurance policy to cover a specified supply of FDA approved, self administered hormonal contraceptives dispensed at one time by a prescriber, pharmacy, or onsite at a licensed or authorized location. Authorizes a pharmacist to dispense those same contraceptives, including a specified supply or when dispensing pursuant to protocols developed by the Board of Pharmacy, up to a specified supply at one time. Relates to covering out-of-network provider prescriptions.

Professions and Vocations

Relates to professions and vocations to include the Dental Corps Scholarship Program, the contracting by the Dental Board for outside consultants to survey and evaluate foreign dental schools, nursing-related continuing education, the conduction of pest control inspections, the reporting of wood destroying pests and organisms removal, and the removal of vertebrate pests.

Driving Under the Influence: Ignition Interlock Device

Requires a person convicted of driving a motor vehicle under the influence of an alcoholic beverage, to install an ignition interlock device on all vehicles that he or she owns or operates for a specified period of time. Authorizes persons convicted of driving a motor vehicle under the influence, who meet specified requirements, to apply for a restricted driver's license, without a license suspension period. Provides criteria for the reinstatement of a person's privilege to operate a motor vehicle.

Professions and Vocations: Board Actions and Regulation

Provides for the review of nonministerial market-sensitive actions of a board within the Department of Consumer Affairs to determine whether it furthers a clearly expressed policy and provides for approval, disapproval, or modifications to a board action. Requires that certain information be posted on the Internet. Requires a public entity to pay a judgment or settlement for treble damage antitrust awards against a member of a regulatory board for certain acts or omissions.

Professions and Vocations: Boards: Competitive Impact

Provides requirements and procedures for the Director of Consumer Affairs to review a decision or other action by a board under the Department regarding a restraint of trade. Prohibits the Board of Nursing Executive Director from being a licensee of the Board. Authorizes a veterinary technician to compound a drug for anesthesia for animals in a licensed premises. Relates to veterinary university licenses. Adds competitive impact as an standard when reviewing regulatory actions of a state board.

SB 1348 - Cannella (R)

Licensure Applications: Military Experience

Requires each board within the Department of Consumer Affairs with a governing law authorizing veterans to apply military experience and training towards licensure requirements to modify their application for licensure to advise veteran applicants about their ability to apply that experience and training licensure requirements.
